Welcome to AmmoInvest! Before using our website or app or making any purchases, it’s crucial that you carefully review and understand the following Terms and Conditions. By accessing or using this site, you agree to abide by these Terms and Conditions and applicable laws. If you disagree with these terms, please refrain from using our services. AmmoInvest reserves the right to update these Terms and Conditions, and you agree to be bound by the most recent version available on our website.

Acceptance of Terms

To complete a purchase, the Customer must acknowledge and agree to the following terms. This agreement is necessary for the purchase process and indicates your acceptance of our Terms and Conditions.

• Age Requirement: To purchase ammunition from AmmoInvest, you must be at least 21 years old. We adhere to this strict policy for legal and safety reasons.
• Fees: Customers acknowledge that using AmmoInvest incurs specific fees detailed in the “Fee Structure” policy.
• Pricing Algorithm: The market price for buying and selling ammunition is determined by a proprietary algorithm known as the American Ammunition Standard that searches the ammunition marketplace and calculates a value based upon a variety of metrics and sources. This ensures that a Customer is always getting a fair price for high-quality ammunition.
• Selection of Ammunition: Customers understand that AmmoInvest will select the specific ammunition they purchase based on the specifications outlined in the app.
• Fees: Customers acknowledge that using AmmoInvest incurs specific fees detailed in the “Fee Structure” policy.

• Purchase of Ammunition: When a Customer purchases ammunition with our website or app, the ammunition is shipped to our warehouse until the Customer requests it to be shipped to them. The Customer can track their ammunition in their digital wallet.
• Sale of Ammunition: When a Customer sells ammunition with our website or app, the Customer receives Store Credit that can be used to purchase additional ammunition, or they can request a “cashout” for their credit. A “Refund” can be requested at the original purchase price minus any applicable fees by contacting Customer Service at: customerservice@ammoinvest.com.
• Sales Tax Responsibility: Customers understand that purchased ammunition is shipped to and stored in our Montana warehouse and is not subject to sales tax until shipped to the Customer. Customers will be responsible for any sales tax applicable based on their shipping location.
• Transaction Cancellations: AmmoInvest reserves the right to cancel any transactions that involve pricing errors or site functionality issues.
• Legal Compliance: Customers confirm that they are not prohibited from purchasing ammunition.
• Local Laws: Customers comply with all laws regarding ammunition restrictions before purchasing or requesting delivery.
• Specifications Changes: AmmoInvest retains the right to modify the specifications of any ammunition caliber listed on its site.
• Privacy Policy Agreement: Customers agree to the terms outlined in the “Privacy Policy,” which explains our commitment to safeguarding your personal information.
• Storage Fees: AmmoInvest currently does not charge storage fees for Customer ammunition but may implement such fees in the future.
• Legal Documentation: Customer acknowledges that they agree to all the Legal Documentation exhibited on the website including “Fee Structure Policy”, “Credit/Return/Refund Policy”, “Privacy Policy”, ”Prohibited & Conditional Use Policy”, “Anti-Money Laundering Policy”, and “Shipping Policy”, as well as any additional language added at a later time.
• Customer Identification: AmmoInvest reserves the right to request a driver’s license or other photo identification upon request when shipping ammunition to the customer or processing a “cash-out” or “refund” to comply with our KYC standards as listed in our polices.

 

Shipping Information:

• Shipping Restrictions: AmmoInvest will not ship to the following locations: Alaska, APO Addresses, FPO Addresses, Hawaii, International Locations, New York City, P.O. Boxes, and Washington, D.C. Additional requirements for shipping apply in certain states: Massachusetts: Valid Firearms Identification Card required; New Jersey: A valid firearms identification card is required; California: Ship only to locations with a Federal Firearms License (FFL) Ammunition Seller Permit; Illinois (outside Chicago); A valid firearms identification card and driver’s license or state I.D. are required; Connecticut: Provide a copy of your Driver’s License and either a Permit to Carry or Ammunition Certificate; New York: Requires either an FFL or Seller of Ammunition Permit.
• Liability for Packages: Once a package is with a carrier (FedEx or UPS), AmmoInvest is not liable for its safety. Customers accept responsibility for their package upon delivery and acknowledge that AmmoInvest is not liable for lost, stolen, or damaged items.
• Shipping Insurance: Shipping insurance purchased through AmmoInvest covers only the monetary value of the shipment. AmmoInvest reserves the right to decide whether to provide replacements or issue refunds.
• Signature Requirement: No signature is required for package delivery unless specifically requested for an additional fee. If a Customer refuses delivery and the package is returned, they will incur any additional shipping charges.
• Address Change Fee: A $10.00 fee will be charged for address changes on orders that have already left AmmoInvest.
• Hazmat Regulations: AmmoInvest uses FedEx and UPS for shipping. Ammunition is classified as a hazmat item and cannot be held at office locations; it must be picked up at designated distribution centers. If a Customer requests to have their package held at an office, it will be returned to AmmoInvest, and the Customer will be responsible for any related shipping costs.
• Lead Exposure: Customers acknowledge that handling ammunition may expose them to lead and agree to indemnify AmmoInvest against related liabilities.
• Proper Ammunition Use: Customers are responsible for using the correct ammunition for their specific firearm.

 

Pricing and Product Information:

While AmmoInvest strives for accuracy, we cannot guarantee that all details, descriptions, prices, or other content are error-free, complete, current, or correct. In the event of an error, AmmoInvest reserves the right to reject or cancel any order, even if it has been confirmed and the credit card charged. If a credit card has been charged, we will promptly issue a refund for the appropriate amount. If a purchase is made at an incorrect price, AmmoInvest may contact the Customer to rectify the transaction. If we cannot resolve the issue satisfactorily, we may cancel the order and issue a refund.

Warranty Disclaimer:

AmmoInvest does not guarantee uninterrupted or error-free functions on this site, that defects will be corrected, or that the site and its server are free from viruses or harmful components. We also do not warrant the accuracy, adequacy, usefulness, timeliness, reliability, or correctness of the materials on this site. Some jurisdictions may not allow the exclusion or limitation of certain warranties, so the above disclaimers may not apply to you.

Indemnification:

Customers agree to indemnify, defend, and hold harmless AmmoInvest, its officers, directors, employees, agents, licensors, and suppliers from any losses, expenses, damages, and costs, including reasonable attorneys’ fees, arising from violations of these terms and conditions or any activities related to their account. This includes any negligent or wrongful actions taken by the Customer or anyone accessing the site through their account.

Limitation of Liability:

In no event shall AmmoInvest, its directors, officers, employees, or affiliates be liable for any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from or related to the use or inability to use the services or products offered. The Customer acknowledges their use of services or products is at their own risk. In jurisdictions where exclusion or limitation of liability for consequential or incidental damages is not allowed, AmmoInvest’s liability is limited to the fullest extent permitted by law.

Arbitration:

All AmmoInvest Customers agree to resolve disputes individually through final and binding arbitration. If you are an AmmoInvest Customer, any dispute arising from these Terms and Conditions, your account(s), or your use of our services must be settled in the courts of Montana, USA. You agree to the jurisdiction and venue of Montana courts, waiving any objections under similar doctrines. Claims must be brought individually; class actions are not permitted.

Disputes will be resolved through confidential arbitration in accordance with the American Arbitration Rules, with the arbitrator’s decision being binding and enforceable. Unless agreed otherwise, the laws of Montana will govern the arbitration, which will be conducted in English in Helena, MT.

A single arbitrator appointed under the ADR Rules will hear the case. The arbitrator may grant any relief a court could, including attorney’s fees, if permitted by law. For claims under $15,000, AmmoInvest will cover filing fees exceeding those of court proceedings, but if the Customer is deemed the losing party, these fees will be added to the final arbitration costs.

The prevailing party is entitled to recover arbitration costs, including attorney’s fees. Claims must be brought individually, and relief granted to one AmmoInvest user will not affect others.
